1. Purpose
These Terms define the conditions for accessing and using the HappySession platform.
2. Service operation
The platform aggregates publicly available environmental data and applies a rule-based engine to provide a contextual reading of surf conditions.
- Data from public sources (swell, wind, tide, weather).
- Rules and heuristics based on surf experience and spot knowledge.
- Synthetic output intended to support decision-making.
HappySession does not guarantee results and does not replace on-site analysis.
The platform also offers an optional conversational coach, based on an artificial intelligence system (language model), which automatically generates personalised responses from the questions asked and the user's profile. These responses are generated automatically, may be inaccurate or incorrect, and do not replace professional advice or a human assessment of conditions and safety.
3. Nature of the service and limitations
The information provided is indicative and may change rapidly based on real conditions.
The user remains solely responsible for their decisions and practice.
4. Liability
Surfing involves inherent risks that using the platform does not remove. HappySession takes reasonable measures to provide reliable information, but cannot be held liable for damages arising from the practice of surfing itself, except in the case of proven fault on its part.
Users must check conditions locally and comply with safety rules.
5. Access and seasonal passes
Access to the platform is free for certain features.
Users may choose to purchase a HappySession seasonal pass through a one-time payment, granting access to additional features for the season indicated at the time of purchase, with no automatic renewal.
The seasonal pass does not constitute a subscription, does not involve recurring payments and does not guarantee any result, availability or performance.
6. Right of withdrawal
In accordance with Article L.221-28 13° of the French Consumer Code, the seasonal pass is digital content supplied on an intangible medium whose performance begins, at the user's express request, before the end of the statutory 14-day withdrawal period.
By checking the waiver box presented before payment, the user acknowledges expressly waiving their right of withdrawal as soon as access to the pass is activated.
Absent such an express waiver, the user has a statutory 14-day withdrawal period from the date of purchase, with no need to justify a reason or pay any penalty.
7. User account
Some features may require account creation. Users are responsible for keeping their credentials confidential.
8. Intellectual property
All content, rules, interfaces and graphical elements of the platform are protected by intellectual property law.
9. Personal data
Personal data processing is described in the Privacy Policy available on the platform.
10. Availability and changes
HappySession takes reasonable measures to ensure the availability and proper functioning of the service, without guaranteeing continuous availability or the complete absence of technical errors.
The publisher reserves the right to modify or discontinue all or part of the service.
For the paid seasonal pass, any prolonged unavailability attributable to HappySession gives rise to the statutory conformity guarantees provided for under the French Consumer Code.
11. Governing law
These Terms are governed by French law and European Union law.
12. Complaints
Any complaint concerning HappySession must first be sent in writing to support@happysession.org, specifying the account concerned, the date and the nature of the problem.
HappySession will endeavour to review the request and respond within a reasonable time. This amicable process does not deprive the user of any remedy available under applicable law.
A consumer mediation process will be put in place, and its contact details will be published in this section once a mediator has been designated, in accordance with Article L.616-1 of the French Consumer Code.
